Terms and Conditions

  1. Booking terms and payment –activities and rentals require full payment the day prior, via bank transfer; however, payment in person is also available – we accept cash and card (with chip).
  2. Cancellation – A customer can cancel an activity with a minimum of 48 hours notice, and can either reschedule the activity or receive a refund. Any cancellations within 48 hours will not be entitled to a refund.
  3. New Brighton Surf Limited reserves the right to cancel an activity or rental due to poor ocean conditions, weather or unforeseen circumstances. Activities generally run in all weather conditions (fine, sunny, hot, cold, wet, windy, stormy, misty); however, in the case of extreme weather or conditions, where an activity or rental may be cancelled due to safety concerns; a full refund will be provided.
  4. For surf lessons, participants must be able to swim in the ocean and must disclose any medical issues during the booking process that may impact or prohibit their participation in this activity.
  5. Age – For all activities and equipment hire, children aged 16 and under must be accompanied by an adult aged 18 or over. All equipment hire bookings must be made by an adult aged 18 or over. For surf lessons, children under 12 must be accompanied by an adult.
  6. We require all participants to sign a customer waiver ahead of attending lessons or hiring equipment. If a participant is under the age of 18 this waiver must be signed by their guardian. 
  7. Lateness – All activities run to a schedule. Please call us if you are running late. Any late arrival by the customer does not extend the activity finish time. The maximum time we wait for a late customer is 20 minutes. Beyond this 20-minute wait, the customer is deemed to have forfeited the activity without refund.
  8. Disclaimer – surfing and other related activities (and the rental of equipment) contain an element of risk, which includes the possibility of serious injury or even the loss of life. New Brighton Surf Limited accepts no responsibility for any sort of loss or damage (caused directly, indirectly, or consequentially or other) whether it be property, personal, financial, injury or death, that may occur for whatever reason, including but not limited to the following: weather and conditions, ‘Act of God’ events, random and unexpected occurrences, equipment related incidents, delays and strikes, and any other reasons. The participant accepts that in the event of injury or death New Brighton Surf Limited and its instructors or guides will not be held liable. The participant agrees to follow all directions given by the instructors or guides.
  9. Any damage (other than reasonable wear and tear) to, or loss of, equipment in use by the customer, either during lessons, tours, or whilst hired, is to be paid for by the customer.
  10. Vouchers or gift cards remain valid for 12 months from date of purchase. Vouchers are transferable but non-refundable.

Conditions of Hire

  1. We require a PHOTO ID as a deposit (in form of personal ID/ Driving license/ passport).
  2. For all rentals, the person hiring is responsible for their own safety and equipment.
  3. All hirers of surf boards should have had a surf lesson or be under the guardianship of an experienced surfer. Inexperienced or beginner surfers are not to surf alone.
  4. All hire sessions are subject to conditions on the day. Should conditions be unsafe we reserve the right to cancel, with refund provided.
  5. To hire out our equipment you need to show a level of competency in the sport you are participating in and/or be with someone who is more experienced and has agreed to be your guardian for the session. If your use of the equipment is deemed dangerous or negligent by us, we reserve the right to terminate the hire period
  6. Customers cannot hire if under the influence of alcohol or drugs or any medical condition that would make it dangerous to participate.
  7. Returning equipment after the time period of rental may incur an additional charge.
  8. All our hires take place at New Brighton Surf Limited on Marine Parade, South New Brighton. Beach equipment, including surf boards, is for use on South Brighton Beach, between Halsey Street and Jellicoe Street. Customers are not allowed to transport our equipment to another venue without written permission from New Brighton Surf Limited.
